American law professor Jonathan Turley recently drew attention to the story of a small Canadian town punished by a human rights tribunal for declining to fly the pride flag at the request of an LGBTQ2 rights organization. Professor Turley’s remarks on the matter were surprisingly restrained, given the number of issues the story raises.

Oddly enough, the town at the center of this controversy is called Emo, a word coined in the ‘80s meaning ‘a music genre characterized by emotional, often confessional lyrics,’ as per Wikipedia. As we’ll see, emotions or feelings certainly play a role here – the town’s name is more than culturally appropriate for the drama it is hosting. A coincidence, no doubt.

Merriam-Webster defines a tribunal as ‘a court or forum of justice.’ Canada of course already has courts and forums for justice, along with well-established criminal and civil processes and procedures. The implementation of tribunals, these new forums, in recent decades by western countries indicates that previously-established courts are perceived to be failing society in some way.
